Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MemoryKit API and website (the “Service”) operated by MemoryKit (“we”, “us”, “our”).

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Store or transmit malicious code, malware, or harmful content.
  • Attempt to gain unauthorized access to other users' data or the Service infrastructure.
  • Exceed published rate limits or use the Service in a way that degrades performance for other users.
  • Store content that infringes on intellectual property rights of third parties.

4. Your Data

You retain full ownership of all content you store through the Service. We do not claim any rights to your data. We process your data solely to provide the Service as described in our Privacy Policy.

You can export or delete your data at any time via the API. We do not use your stored content to train machine learning models.

5. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. The Service is provided “as is” without warranty of any kind, express or implied.

6. Pricing & Billing

Free tier usage is provided at no cost with published limits. Paid plans are billed monthly. We reserve the right to modify pricing with 30 days notice. You may cancel your subscription at any time, effective at the end of the current billing period.

7. API Keys & Security

You are responsible for securing your API keys. Do not share keys in public repositories, client-side code, or insecure channels. We are not liable for unauthorized access resulting from compromised API keys.

8. Limitation of Liability

To the maximum extent permitted by law, MemoryKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Termination

We may suspend or terminate your access if you violate these Terms. You may terminate your account at any time. Upon termination, your data will be permanently deleted within 30 days unless you export it beforehand.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify you of material changes via email or in-app notification.
